OPEN BURNING REGULATIONS

 

Open burning in Canby Fire District is under the guidelines set fourth by DEQ. This open burning applies to domestic waste, which is paper, cardboard, natural fiber clothing, yard debris and other material actually generated in or around a dwelling.

Classifications Of Burning

City Backyard Burning: Burning of appropriate materials during permitted times within the city limits of Canby. This includes burn barrels.

Rural Backyard Burning: Burning of appropriate materials during permitted times outside of the city limits of Canby. This includes burn barrels.

Fourth Class Agricultural Burning: Materials generated from a cash crop e.g. tree trimmings from an orchard. Materials from a residence do not qualify as Fourth Class Agricultural.

 

Rules For Legal Burning

  1. Open burning may only be conducted on a burn day. To find out if it is a burn day telephone 503-266-1195 after 8:00 am each morning.
  2. Listen carefully to the recorded message for classification of burning permitted and hours of burning.

  3. A responsible person or an expressly authorized agent shall constantly attend all open burning until extinguished.
  4. A charged garden hose of sufficient length must be available to extinguish the fire.
  5. Firefighting tools shall be available (rake, shovel, etc.)
  6. No person shall burn any wet garbage, plastic, wire, insulation, automotive parts, asphalt, petroleum products, petroleum treated materials, rubber products, animal remains, animal / vegetable matter from handling, preparation, cooking, or service of food.
  7. No person shall burn any material that normally emits dense smoke or noxious odors.
  8. Any open burning must be at least fifteen feet from a structure and the burn pile on larger than five feet across.
  9. Burning in a burn barrel burning must be at least fifteen feet from a structure and have screen cover the top of the barrel.
  10. All fires must be extinguished by the time stated on the burn message.
  11. Contractors and most businesses (except those classified under 4th Class Agricultural) are not allowed to burn at any time per DEQ.
  • If you are legally burning, this does not exempt you from any civil or criminal liability for damages resulting from your fire. You must comply with any other laws, rules, ordinances, permit or decree of any other governmental entity having jurisdiction.

 

If you are caught illegally burning, you will be subject to penalties from DEQ.
